WHAT IS A SECTION 5?

A section 5A notice is served on leaseholders when the landlord intends to sell the freehold. There is a legal obligation on landlords to serve the notice to purchase the freehold on leaseholders before they sell on the open market. This is called the right to first refusal.

If you’ve received a Right of First Refusal Notice, often called a ‘Section 5a’ or ‘Section 5b’, it is important to view this as a great opportunity, possibly even a ‘dream come true’ if you have previously thought about buying your freehold and decided it was all too complicated.

It is also important to remember that time is very much of the essence. At RJC Leasehold, we firmly believe that every flat owner, where possible, should purchase the freehold of their building to gain full autonomy of their own property and financial destiny. We hope this website will give you all the details you need to make an informed decision.
